Dear Families, 

As required by Michigan law, we are providing you with important information about the state’s Secure Firearm  Storage Law, also known as the Child Access Prevention (CAP) law (Public Act 17 of 2023). The law imposes  requirements and provides guidance for safe storage of firearms in situations where minors are or may be  present, with the goal of preventing accidental injury, unauthorized access, and other harm. 

What the Law Requires 

When minors may be present: If a firearm is on premises under someone’s control and a minor is or is  likely to be present, the firearm must be either: 

1. Stored in a locked box or container, and/or 

2. Unloaded and locked with a locking device that renders the firearm inoperable by those who  are not authorized users. 

Penalties: If a minor obtains a firearm that was not stored according to the law, there may be criminal  penalties depending on the outcome (e.g. possessing/exhibiting the firearm in a public place or causing  injury or worse). 

Exceptions: There are limited exceptions (for example, when minors are under supervision, for lawful  activities, etc.). For full details about exceptions, consult the law or official State resources.


What You Can Do: Safe Storage Best Practices 

To help protect your family and comply with state requirements, here are best practices for safe firearm  storage: 

• Always unload firearms before storing them. 

• Use a locked container or safe, or a locking device such as a trigger lock or cable lock to render the  firearm inoperable by unauthorized users. 

• Store ammunition separately from firearms, ideally in a locked location. 

• Ensure that keys, combinations, or lock access mechanisms are not readily accessible to minors. 

• If you leave firearms unattended in places outside of your home (for example, in a friend’s home), take  similar precautions.

• Free or low-cost options for firearm locks are available through various state agencies, local law  enforcement, or health department offices. 

• The Michigan Department of Health & Human Services (MDHHS) has developed materials and FAQs  about safe storage.

Secure firearm storage helps to: 

• Prevent accidents and unintentional injuries among children. 

• Reduce the likelihood of a firearm being misused by someone without authorization. • Promote safety and peace of mind in our homes and school communities.
